In a significant move to safeguard the rights of vulnerable workers holding temporary visas, the Albanese Labour Government is taking decisive action after a decade of inaction under the former Liberal Government. The outcomes of a month-long operation targeting businesses taking advantage of migrant workers have been unveiled today.
During July 2023, officers from the Australian Border Force (ABF) meticulously inspected approximately 300 establishments across all states and territories. This operation follows the 140 enterprises that faced penalties within the initial year of the Albanese Labour Government’s tenure. The ABF focused its efforts on businesses involved in sponsoring migrant workers, imposing fines, bans, and other punitive measures against those who disregarded fundamental workplace entitlements, encompassing fair pay, suitable conditions, and health and safety standards.
The Albanese Labor Government is actively planning further reforms to enhance the protection of migrant worker rights. In this regard, the Migration Amendment (Strengthening Employer Compliance) Bill 2023 has been introduced. This proposed legislation equips the ABF with innovative tools to discourage exploitation and is set to undergo debate in the House of Representatives today.
Minister for Immigration, Citizenship, and Multicultural Affairs, Andrew Giles stated that shockingly, recent statistics indicate that as many as one in six migrants are currently receiving less than the mandated minimum wage. The government’s immediate focus is to shield migrant workers from exploitation while simultaneously preparing for comprehensive reforms. The proposed Employer Compliance Bill will focus on targeting employers who seek to exploit and underpay workers.
Workplace regulations in Australia are uniformly applicable to all individuals working within the country. Regardless of their visa status or migrant background, all employees, including visa holders and migrants, are entitled to the same workplace rights and safeguards. Employers who hire migrant workers are obligated to adhere to both Australian labor laws and immigration regulations. Familiarising yourself with your work rights and entitlements will guarantee equitable and respectful treatment.
