Starting on 14 October 2024, Australia will see a significant shift in how migration and refugee decisions are reviewed with the introduction of the Administrative Review Tribunal (ART), set to replace the current Administrative Appeals Tribunal (AAT). Seamless Transition for Current Cases
If you currently have a migration-related review underway with the AAT, rest assured there’s nothing extra you need to do. Your case will automatically move to the ART without any disruption. The same staff will handle proceedings at the same locations but with a fresh mandate to ensure fairness and hopefully efficiency under the new rules.
What Happens to Recent AAT Decisions?
For recent decisions made by the AAT, the new Tribunal will not reevaluate them. However, if a decision was made within the last 35 days, there’s still a window to seek further review from federal courts.
New Applications for Review
If you’re facing a new government decision related to migration or refugee status and haven’t yet applied for a review, you have until 14 October to submit your application to the AAT. After this date, the ART will take over, but don’t worry—applications related to decisions made before 14 October are also welcome under the new system. This ensures that everyone has a chance to have their voice heard and their case reviewed fairly.
